Who are the services of copiedacte.fr for?


The services of copiedacte.fr are aimed at both individuals and professionals. Offers are especially provided for these whose requests can be recurrent and frequent.

A real estate agency, a real estate developer or a developer can do a search on a property on which they wish to carry out a project (subdivision, promotion etc ...).

Individuals will use the site instead, to find a copy of deed or do a search on family property.


How is the research conducted?


After validation of the order, we contact you to validate the progress of the mission.

In case you have a doubt (on the nature of the request, the type of order to spend etc ...), you can use this form to contact us to detail the search you want to perform.

The result of the research is communicated by email in dematerialized form (possibility of sending by mail on request).

 

Are the searches confidential?


The searches are completely confidential, in no case the owner of a property is informed of the search.


What elements must be communicated to perform a search?


The easiest way is to give us the cadastral references of the property on which you wish to search.

This manual explains how to obtain the cadastral references.

In case you do not have the cadastral references, you can give us the postal address of the property.


How to know the history of the owners of a parcel?


Two solutions, either to address you directly to the service of the land advertisement (with the risk of not filling correctly the forms, to waste time and money).

Either you entrust us with your research, we commit ourselves to the deadlines and the costs.


Mortgage Retention or Land Registry Services?


Since January 1, 2013, the preservation of mortgages (sometimes called mortgages office) has become the service of land advertising.

 

What is a mortgage state?


A mortgage state is a document that establishes the registrations taken on a building. The mortgage statement is archived with the Foncière Publicité service.


On the mortgage state figure:


- existing easements on the building

- mortgages taken on the building

- the name of the owner

- the details of the condominium lots

- the purchase price of the building

- the type of act passed on the building (donation, sale etc ...).

- the elements of publication of the acts.

Can I get a copy of a notarial deed on property that does not belong to me?


Yes we can make this type of request, indeed Article 2449 of the Civil Code provides that:

"The services responsible for land registration are required to deliver, to all those who request it, copies or extracts documents, other than the registration slips, which are filed therein within the fifty years preceding the one of the requisition, and copy or extract any remaining entries or certificate that there is no document or entry in connection with the requisition. "


What to do in case of loss of a title deed?


If you have lost your deed of ownership, we can request a copy from the land registry services. You just have to tell us on which parcel or person your request is.


How to know the details of an easement?


If you wish to know if your property is encumbered with an easement or on the contrary if you benefit from an easement and wish to know the details (width of an easement of passage, grip of the servitude etc ...).

What is the role of the Land Registry Department?


It is defined by Decree No. 55-22 of January 4, 1955 on the reform of land registration, its main role is the maintenance of a real estate file on which, as and when deposits are listed, under the name of each owner, and, by building, extracts from published documents, with reference to their classification in the archives.

The real estate file presents, as it results from the published documents, the current legal situation of the buildings.

This file is a real database of "the civil status" of real estate, it includes many elements such as:

- the names of successive owners
- any easements
- the origin of the property
- the identity of the current owner
- mortgages taken on a property

etc ...


How does the Land Registry Service work?


The Land Registry Service plays a dual role in the maintenance of this real estate database.

The land registration service receives the acts of notaries or administrative acts and publishes them (the publication is the act of making this information accessible to third parties).

And on the other hand, it responds to requests from users (professionals and individuals) and transmits, following these requests, information on a building, a person, an act in particular etc ....


What is the point of obtaining this type of information?


The data of the service of the land advertising is a real gold mine for the real estate investor. Indeed, these data make it possible to answer the following questions:

- Who owns a property?

- What is the purchase price of a house, a building ...?

- What servitudes are grazing land, a plot?

- What is the history of a property (successive owners)?

- Is a property subject to a mortgage?

The answers to these questions can help you negotiate the purchase price of a good (it's easier to make an offer when you know the seller's purchase price), to avoid going through a real estate agency directly determining the identity of an owner etc ...


What does a mortgage statement contain?

1) Designation of the building:


In the designation of the building, there is a quick description of the property (villa, apartment, land etc ...), and the lot number and the directors of condominiums in the case of a property in co-ownership.

If the request was made on a parcel hosting a subdivision or a condominium, it will be detailed the number of lots and information on the different lots (building, floor, staircase, nature of the lot, fees etc ...).


2) Mutation / Active Servitudes:


You find here the detail of each sale, donation, creation of servitude etc ... having affected the real estate.

In this part, the purchase price is indicated as well as the date of acquisition. As part of a donation, the amount of the valuation of the property will be indicated. You also find the elements relating to the identity of the participants in the act (seller, purchaser, notary ....).

In the case of an easement you will have the indication of the serving background (sometimes of the dominant bottom). The type of servitude (passage, sight etc ...) is not necessarily specified.


3) Charges, liens and mortgages:


You find here, the different privileges, mortgages (conventional, judicial ...) that could be taken on the good. If these guarantees are no longer short, they are crossed out with the words "canceled or expired".

The identity of the beneficiary of the guarantee and its amount are also indicated.

The end date of the mortgage is indicated and preceded by the words "effect until".
